The Problem of Visitors from Outside the Sites

Condominium Law and Common Area Boundary
According to the Law on Condominium Property (KMK), common areas are open for use by condominium owners at the rate of land shares. However, the law says that this use must be carried out "in such a way as not to impede the rights of other owners”.

If an apartment owner brings a group of 10 to 15 guests, other than his own family, to the pool or camellia of the site and occupies the space for hours, preventing other rights holders from enjoying that service, this is legally a "violation of rights”.

Can the administration prohibit guest entry?
This is the most curious question: can the board of directors meet and make a decision “No guests are allowed to enter the pools and facilities”?

Answer: Yes, it can take. But this must be done in due course.

If there is a restriction on the use of social facilities in the Management Plan of the site or a “Regulation on the Use of Social Facilities” has been adopted by a majority vote in the General Assembly of Floor Owners, the administration may impose restrictions on the entry of guests.

For example: “On weekends, guests are not allowed in the pool area due to the density, and on weekdays a maximum of 2 guests can be brought per apartment” are fully valid in law and all residents must comply.

Separation of Relatives and Day Visitors
The fine line here is the duration of the stay. Temporary guests who stay in your home and live with you can naturally take advantage of the facilities of the site with you. However, the management can prevent the unlimited use of social areas by the management, who come from outside on a daily basis for the sole purpose of “going to the pool, barbecue”.

How does the manager deal with this crisis? The
most logical thing you should do as an administrator to avoid these midsummer debates is to set a flexible but clear set of rules. Introducing a reservation system for camellias, placing apartment number-based checks on pool entrances, or setting specific quotas for guests (or a tiny facility usage fee for guests on busy sites) both ensures fairness and prevents neighbors from being hostile to one another.
